MOMIJI USER LICENSE

Your use of the Momiji application beyond the welcome window is considered agreement with the terms of this license. Please read the terms carefully before proceeding.

DEFINITIONS

Path10 offers this definition list to provide clarity for the remaining portion of the license. Please familiarize yourself with the listed terms.

• App Search: A feature which offers to forward the already-provided search term (or logical derivative thereof) to an installed application which may be better suited to serve and/or display results.
• Calling Card: A method for businesses and individuals to gain visibility and exposure with Momiji users.
• Charity: With regard to the "Charity Tier" of Calling Card functionality, an organization that operates as a non-profit or one with minimal funding while simultaneously being mission-driven and where this mission is for the social good of the public.
• Curation: The combination of automated and manual selection of content for inclusion within Momiji.
• Jurisdiction: A potential combination of country, state/province/prefecture/canton (or other similar administrative region), and municipality.
• Objectionable Content: Web content which some users may find undesirable.
• Site Search: A feature which offers to forward the already-provided search term (or logical derivative thereof), via the user's web browser, to a given web site which may be better suited to serve and/or display results.
• User(s): This means yourself and anybody else who makes use of Momiji.
• Web Content: The expressive combination of larger bodies of text, images, videos, fonts, audio, etc... made available by web sites.
• Web Site(s): The hosts of online content.

REGARDING THIS LICENSE

• The English language version of this license shall supersede others in the case that multiple languages are offered.
• Path10 reserves the right to make changes to this license over time. Path10 will always make the embedded version of this license available in Momiji's menu for later reference by users.
• If multiple versions of this license exist, the newest version shall supersede the former version(s).

GENERAL

1. All users, who are of age of majority in their respective jurisdictions, are allowed to install, and make use of Momiji as a search engine, free of charge. Users agree not to charge other users for this privilege.
2. The Momiji app is open source and governed by the Apache License v2.0. This means, within the terms of said license, users are allowed to open the source code, study it, reverse engineer it, augment it etc...
3. The user understands that Momiji is offered AS IS, and Path10 makes no guarantee of any particular fitness for any purpose.
4. Additionally, the user understands that Path10 is not obligated to, and does not provide support/consultation services for any individual looking to make derivatives of Momiji.
5. Derivatives of Momiji are prohibited from availing themselves of server-side features offered by Path10 and Path10 is in no way obligated to support said derivatives.
6. The user agrees not to copy the data within the Momiji index, nor copy the data within Momiji index update files, nor induce anybody else to do either, for use with offering any Momiji derivative. Any user interested in creating a derivative of Momiji agrees to start from scratch and curate web content using the user's own equipment and resources.
7. The user agrees not to attempt to connect to any server, network or equipment under the control of Path10, outside of the regular functionality offered directly via Momiji, for any purpose.
8. The user agrees not to place any undue burden on any server, network or equipment under the control of Path10, nor induce anybody else to do such.
9. The user agrees not to name any Momiji derivative with a similar name, nor induce anybody else to do such, which could confuse other users. Exercise some creativity here!
10. The user reserves the right to continue using any given version of Momiji, without obligation to upgrade, even if newer versions exist.
11. Path10 reserves the right to add and update server-side features which may compel the user to upgrade the local installation of Momiji, in order to begin or continue availing of server-side functionality. The user understands such and can elect whether to upgrade or forego upgrading, and accepts the trade-offs of either choice.
12. The user understands that Path10 operates in Japan and offers Momiji as a publicly and freely available search engine under the specific allowances afforded by Japanese Copyright Law Article 47-5 paragraph (1) item (i) and item (iii), and paragraph (2), Article 48 paragraph (1) item (iii), and paragraph (3) item (i).
13. Path10 reserves all rights to curate content at its discretion and without need to justify any curation decisions.
14. The user understands that downloading the Momiji index update files may incur increased data costs upon the user, and that Path10 recommends avoiding downloading said files when on a cellular connection or other at-cost connection.
15. The user understands that inclusion or exclusion of any given web contents is not necessarily an endorsement of, nor discrimination against said web contents on the part of Path10.
16. The user understands that Momiji does not host web content directly, it only links to said web content which is hosted elsewhere.
17. The user understands that, with the exception of Calling Card customer-provided content, Momiji does not pull web content into its interface for internal display, it only launches a web browser or an installed app best suited to display said web content.
18. The user understands that Momiji requires sufficient storage space on the local device for storing the index, as well as intermediary index update files.
19. The user who installs Momiji on this device agrees to be responsible for the activities taken by others within Momiji on this device.
20. The user who installs Momiji on this device agrees to be responsible for the adjustments to the objectionable content thresholds, in the event that such adjustments are made available in the user's jurisdiction.
21. The user understands that, with the exceptions of Calling Card functionality and responses to user reports via email, Path10 will NEVER engage in correspondence over telephone, fax or email with any given user, and should such correspondence be encountered, the user agrees to treat it with utmost suspicion of being a phishing attempt.

USER PRIVACY

1. The user understands that all searches in Momiji are performed locally on the user's device and Path10 is NEVER privy to these.
2. The user understands that no user account is ever required in order to perform searches in Momiji.
3. The user understands and agrees that App Searches are not necessarily private and Momiji will inform the user of this in the interface as a safeguard.
4. The user understands and agrees that Site Searches are not necessarily private and Momiji will inform the user of this in the interface as a safeguard.
5. Path10 will, with the necessary exception of provisioning Calling Card functionality, NEVER induce users to sign-up or create a user account.
6. The user understands and agrees that reporting search results will occur via email and that the user's email address will be revealed during such.
7. The user understands that reporting any search result will cause a report ID to be created and until the report is deemed "closed", the correspondence with the user will be retained in full.
8. Path10 will erase from its mail server the full correspondence for a given reporting case once said reporting case is deemed "closed" by Path10.

SEARCH ENGINE FUNCTIONALITY

1. Path10 reserves the right to add, update and delete curated results to the Momiji index over time.
2. The user understands that Momiji may offer search results which have become stale over time and which, when visited, may not yield any content, no-longer accurate, or mismatching/irrelevant content, including but not limited to pricing information when such is included in a page's title.
3. The user understands that, while Path10 strives to correctly mark content with language indicators, mistakes may be made and the actual language may differ from time to time.
4. The user understands that Path10 may from time to time make objectionable content scoring errors when curating content, and that objectionable content scoring performed at the time of curation may not always reflect the current state of said web content.
5. The user understands that some search results are marked as "unrated", meaning they currently lack an objectionable content score. The user agrees to verify and if necessary, to adjust the setting in Momiji which allows such unrated content to be treated as highly objectionable.
6. The user agrees to avail himself/herself of the "Hide" functionality for individual search results which are deemed offensive, prior to electing to report said search result to Path10.
7. The user agrees to only report search results which have legitimate legal or retrieval issues, and not to misuse the functionality.
8. The user understands and agrees that reporting any search result to Path10 does not necessarily guarantee its removal nor its re-evaluation.
9. Path10 will accept "in good faith" reports and treat each on a case-by-case basis, however Path10 makes no guarantee as to how quickly this may occur.
10. Users agree not to hold Path10 responsible for the objectionable content of user comments on any web site. Web site operators are responsible for upholding their own moderation standards and users are recommended to approach web site operators with any claims.
11. The user understands that places exposed in location results within Momiji may become stale and no longer existent. The user agrees to indemnify Path10 in such an event of staleness.
12. The user understands that location distances displayed in Momiji are merely approximate calculations based on "as the crow flies" comparisons between the user's approximate GPS coordinates and the location's GPS coordinates.
13. The user understands and agrees that Momiji search results may link to web contents offering opinions, views and/or information which may be subjectively considered as untrue. The user understands and agrees that the onus is on the user to exercise independent, critical thinking when consuming web contents linked to by Momiji.
14. The user understands and agrees that Momiji may display tags and search results including company, product and service names which may be trademarked and that Path10 makes zero claim of ownership over such and zero claim of association/relation with the owners of said trademarks and zero claim of quality/suitability for said offerings.

BOOKMARK FUNCTIONALITY

1. Bookmarks (as a collective expression of titles, URLs, tag words and timestamps) added within the device's Momiji instance are the full property of the user and Path10 makes no claims of ownership with regard to user bookmarks.
2. The user understands that Path10 is NEVER privy to the state of the user's bookmarks.
3. The user understands that Momiji will NEVER manipulate the user's bookmarks without manually being set in motion by the user.
4. The user agrees to abide by all local laws in the user's jurisdiction with regard to bookmarking/linking to web content.
5. The user can import (using various standard formats) and export bookmarks (in HTML format) at any time.
6. Path10 will be indemnified in the event of loss of data, including but not limited to user bookmarks.
7. The user understands and agrees that, in the interest of privacy, Path10 does not, and will not ever, offer an online backup feature or "cloud storage" of any kind for bookmarks.
8. The user agrees to not bookmark web content which is deemed illegal in the user's jurisdiction, and the user will indemnify Path10 of all responsibilities in the event of bookmarking illegal web content.

SHARING FUNCTIONALITY

1. The user understands that Momiji is NOT a social media platform and that Path10 does not facilitate direct user-to-user communication via Momiji.
2. The user understands that, unless available at/under https://www.path10.net/, Path10 makes zero claims of ownership with regard to the web contents which are reachable from search results made available via Momiji, and that this may have implications for sharing rights.
3. The user understands that the licensing descriptions accompanying search results may from time-to-time be incorrect. The user agrees to check the web content hosted at each search result's URL for up-to-date licensing information prior to making use of the content.
4. The user is permitted to share search results (the titles, URLs and latitude/longitude coordinates) via the methods built into Momiji.
5. The user is permitted to share bookmarks via the methods built into Momiji.
6. The user agrees to consult with web site operators for deeper content (images, videos, audio) usage questions.
7. The user understands and agrees that any web content appearing in results shared by the user on any social media platform is INCIDENTAL, and the sole responsibility of said social media platform and that Path10 CANNOT and DOES NOT induce any platform to deep link to web content in order to present images, icons and/or videos. The user will indemnify Path10 of any copyright or trademark infringement claims in any such event.

CALLING CARD FUNCTIONALITY

1. The user understands that the Calling Card feature is not available in some jurisdictions, solely at the discretion of Path10.
2. Calling Card users understand and agree that the "Full Tier" is billed using a yearly subscription model. Furthermore, Calling Card users understand that the billing date need not occur on the same date of the first-ever inclusion of a Calling Card within a Momiji index update.
3. Any given "Full Tier" Calling Card will, within the law and Path10's ability to operate, be available for at least 1 year after the first-ever inclusion within an index update, even should the "Full Tier" subscription be cancelled after said first-ever inclusion. The first-ever inclusion timestamp will be recorded in the Calling Card entry and Momiji will add to this date (treated as a leap year of 366 days x 24 hours x 60 minutes x 60 seconds).
4. Calling Card users understand and agree that Path10 makes no claims with regard to Momiji user count. This information is NEVER tracked by Path10. The user understands that all mentions of Momiji users will be in the plural form (in languages which make singular/plural distinctions) as it is more natural sounding, and that this does not imply any specific number.
5. Calling Card users understand and agree that the Calling Card feature is intended as exposure and not to be used as promotional advertising.
6. Calling Card users understand and agree that Path10 does not guarantee immediate distribution, of any submitted Calling Card. Submitted Calling Cards will undergo minimal vetting for objectionable content and, barring any glaring issues, will typically be slated for inclusion in the next index update.
7. Calling Card users understand and agree that, while Path10 strives to offer a regular cadence for Momiji index updates, Path10 cannot not guarantee such. Accordingly, submitted Calling Cards are not guaranteed to be distributed every day or week.
8. Calling Card users agree to use the dedicated promotions link within each Calling Card to communicate "timely" content such as sales, and to refrain from placing such information in other Calling Card text fields.
9. Calling Card users understand that regular Momiji users can choose how often to check for index updates and that this will become a factor for when a Calling Card can first become available to users.
10. Calling Card users understand that regular Momiji users are in full control of the sort order of search results, as well as an optional geofence for location-based searches, and that there is no guarantee of where/if a Calling Card will be displayed amongst other search results.
11. Calling Card users agree to use tags "in good faith" to increase the likelihood of appearing in search results. Path10 reserves the right to investigate Calling Cards suspected of or reported by Momiji users for keyword-stuffing, and to terminate Calling Card users in cases. Path10 makes tags reasonably abundant for the various tiers so get creative and let's help Momiji users find what they're looking for.
12. Calling Card users agree to populate Calling Cards with content in the matching supported language (ex: English content in the English Calling Card and Japanese content in the Japanese Calling Card) and not to avail of other language editions as a secondary Calling Card page to expand reach within the primary language.
13. Calling Card users understand and agree that Path10 reserves the right to define the term "charity" when referring to the "Charity Tier" and that this definition may differ from the legal definitions of various jurisdictions. Furthermore, Path10 reserves the right to classify any organization as being a charity or not being a charity using its own definition.
14. Path10 reserves the right to amend and even cancel any of the Calling Card tier offerings at any time, however will, within the law and Path10's ability to operate, honor the commitments to "Full Tier" users already signed up, for the term of their billing.
15. Calling Card users understand that keeping content clean and family friendly is the best way to achieve reach with Momiji users.
16. Path10 reserves the right to not do business with any prospective Calling Card user. This may include but is not limited to users in criminal groups, extremist or hate groups, and/or having terrorist affiliations.
17. Hate towards a group of people will not be tolerated within Calling Card content. Furthermore, Path10 reserves the sole right to determine what constitutes hateful content and will investigate each on a case-by-case basis.
18. Path10 reserves all rights to terminate a Calling Card user for violating any portion of this license.
19. Calling Card users understand and agree that, outside of the "Full Tier", there is no support obligation by Path10.
20. There are NO REFUNDS, pro-rated or otherwise, for Calling Card users should they be terminated by Path10, or if said Calling Card users elect to remove themselves.

ARBITRATION

1. Momiji is a passion project and is offered to be of service to everyday users, and legal arbitration is never preferred in the case of legal issues, be they copyright-related or other. If users reach out to legal@path10.net in good faith, they will met in kind, amicably. Nevertheless, should arbitration be deemed the only course forward, the user agrees that such will occur within Japan.
